Terms and Conditions


Welcome to the terms and conditions ("Terms") for Volunteer Primary Care Heath Care Services Membership Program (Membership Program). These Terms are between you (the patient(s)) and Volunteer Primary Care, LLC and/or its affiliates ("VPC" or "Us") and govern our respective rights and obligations. Please note that your use of the Volunteer Primary Care Health Care Services Membership Program is governed by the agreements listed below, as well as all other applicable terms, conditions, limitations, and requirements on the Volunteer Primary Care website, all of which (as changed over time) are incorporated into these Terms. If you sign up for a Health Care Membership, you accept these terms, conditions, limitations, and requirements.

 

Membership Cancellation

You may cancel your membership at any time by mailing a written letter or emailing the practice at volunteer@volunteerprimarycare.com. If you decide to cancel any time after the initial registration fee, or monthly membership fee, has been processed, you will not be eligible for a refund. If you decide to cancel, the next monthly membership fee will not be charged to your card on file. 

 

Other Limitations

 - We reserve the right to accept, refuse, or cancel a membership at any time at our discretion.

 - We may send you an email and other communications related to your membership (regardless of any settings or preferences related to your portal account).

 - You may not transfer or assign your Health Care Membership to any person at any time.

 - No other person may benefit from your membership at any time.

 - From time to time, Volunteer Primary Care may choose in its sole discretion to add or remove Health Care Membership Program benefits with or without notification of such changes.

 - We have the intent to share any benefit changes prior to the changes taking effect. 

 

Fees and Renewal

The fee for the Membership Program is stated in the Membership Program section of our web site and on the Volunteer Primary Care Health Care Membership Program registration form. From time to time, Volunteer Primary Care may offer different membership terms, and the fees for such membership may vary. The Membership fee is non-refundable as expressly set forth in these Terms under “Membership Cancellation”. The Membership fee is a flat fee based on the type of membership selected by the patient as detailed on the registration form. 

The billing terms described below will apply to your membership.


You must complete the Credit Card Authorization Form and provide a valid check card or credit card to be kept on file for the monthly fee. If all eligible payment methods we have on file for you are declined for payment of your membership fee, you must provide a new eligible payment method promptly (within two weeks) or your membership will be canceled. If you provide us with a new eligible payment method and are successfully charged, your membership will continue uninterrupted. You will not be able to be seen by a provider until your monthly membership fees are current. After 90 days of non-payment of membership fees, your membership will automatically be canceled. Returning to the membership program will require a new registration and payment of the registration fee.     

UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.


Missed Appointments or No-Show Policy

I understand that if I schedule, and do not keep the appointment:

a.  I will still be charged the $20 visit fee (non-member $40 no-show fee according to the billing policy)

b.  The missed appointment will count as one (1) of my two monthly visits included in the membership

c.  The appointment must be canceled at least two (2) hours prior to the appointment's scheduled time to avoid “a” and “b”.

Missing an appointment denies another patient from receiving the care they need. Please be courteous to our staff, providers, and other patients by keeping your appointment. Things happen and we appreciate that. When they do, please let us know to reschedule or cancel your appointment.

 

Agreement Changes

We may in our discretion change these Terms, Volunteer Primary Care Health Care Membership benefits, Information and Privacy Statement, or any aspect of the Membership Program, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

 

Termination by Us

We may terminate your membership at our discretion without notice. If we do so, we will give you a written notice of cancellation with the remaining time period of your membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms, the Patient Conduct and Responsibilities, or any applicable law, involves fraud or misuse of the membership, or is harmful to our interests, our staff, or another patient. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.


Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN VOLUNTEER PRIMARY CARE’S TERMS AND CONDITIONS OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR PRIME MEMBERSHIP.


Disputes

Any dispute or claim relating in any way to these Terms and Conditions, or your use of the Membership Program, will be adjudicated in the state or Federal courts in Sevier County, Tennessee, and you consent to exclusive jurisdiction and venue in these courts. We each waive any right to a jury trial.
